Garry Rogers Motorsport has lodged an appeal with the Australian Motor Sport Appeals Court, which is expected to be heard prior to the Bathurst 1000 on October 18.

Herne was knocked back in his initial application for a SuperLicence with Garry Rogers Motorsport director Barry Rogers confirming the team was pursuing the matter further last week.

Motorsport Australia has now officially confirmed that the appeal will be heard by AMSAC after a meeting between the governing body and the Supercars Commission failed to award a dispensation.

This was conducted with data provided by GRM after its test day at Winton a fortnight ago.

AMSAC is GRM’s final right of appeal outside of a civil court.

“Senior representatives from Motorsport Australia, together with the full Supercars Commission met last week to consider the application by Nathan Herne for a Superlicence dispensation,” said a statement issued by Motorsport Australia CEO Eugene Arocca.

“All material previously submitted by Mr Herne together with additional information that was not available at the time of the initial dispensation application was considered by this panel including additional references, along with data from a recent test day provided by GRM.

“Following consideration, it was unanimously determined a dispensation would not be issued in this instance based on all the information submitted as part of this process and before the panel.

“GRM has now indicated it will lodge an appeal with the Australian Motorsport Appeal Court (AMSAC) and this independent body will hear the matter as soon as it is able.”

Team personnel are currently split quarantining in Darwin and Sydney.
